United States Supreme Court Rules The Memorial Cross Will Stand
CPCF Legal Team: The United States Supreme Court upheld the constitutionality of the Bladensburg Peace Cross. The vote regarding constitutionality was 7-2. The question as to the fate of the much reviled 3-part Lemon test is more complicated, as there were seven opinions written by the nine Justices. Four justices signed onto the part of Justice Alito’s main opinion that states that Lemon should not apply in cases involving “religious references or imagery in public monuments, symbols, mottos, displays, and ceremonies.” In two separate opinions, Justices Thomas and Gorsuch stated that they “agree” with this part of Justice Alito’s opinion, but had other reasons for writing separate opinions. Thus, there are six votes that Lemon no longer applies in these category of cases. However, Justice Breyer (one of the four votes on the main opinion) hedged a bit in his concurring opinion, perhaps reducing the total to five votes. Various Justices would limit its application further or outright overturn it. The CPCF joined an amicus brief.

CPCF Legal Team: On Monday, June 17, the United States Supreme Court sent the case of Klein v. Oregon Bureau of Labor and Industries (often referred to as the “Sweet Cakes” case) back to the Oregon Court of Appeals, without hearing argument in the case. The Kleins, owners of the Sweet Cakes by Melissa bakery, were fined $135,000 by the Oregon agency for refusing to make a cake for a same-sex wedding. The Court’s action is a very encouraging sign, since it instructed the Oregon Court of Appeals to reconsider its decision upholding the fine in light of the Supreme Court’s decision last year in Masterpiece Cakeshop case, in which the Court reversed a similar decision by the Colorado Civil Rights Commission. The CPCF joined an amicus brief.

WA: Game Not Over For Praying Coach
CPCF Legal Team: Thank you for praying with us that the Supreme Court would grant the cert petition of Coach Kennedy, who was fired for bending the knee and praying by himself on the field after a football game. The Supreme Court on January 22 denied the petition, but Justice Alito, for himself and Justices Thomas, Gorsuch, and Kavanaugh, wrote a statement that the reason they voted to deny review was that it was not clear that that was the only reason the coach had been fired. Justice Alito then went out of his way, however, to say that, if it were, the case would likely be suitable for review and criticized several comments of the Ninth Circuit decision that could be viewed as antagonistic to religion and prayer.
