Problematic Anti-Religious Freedom Bills Springing Up Across The Nation

  • Conversion Therapy Ban: These are bills that are seeking to prohibit licensed mental health practitioners from counseling minors struggling with sexual orientation or gender identity according to Biblical truths.

  • Conversion Therapy Ban – Expanded: These are bills that are seeking to prohibit licensed mental health practitioners, and pastors or religious leaders, from counseling minors struggling with sexual orientation or gender identity according to Biblical truths.
  • “Non-Discrimination” Laws or “Civil Rights” bills: These are bills that seek to make sexual orientation or gender identity a protected class, providing equal protections as race, color, sex, or ethnic origin. Some versions state that businesses or corporations who deny services based on moral grounds won’t even have a chance in court. 

Big Cases To Watch At The Supreme Court In 2018

1. Decision in Masterpiece Cakeshop

“The justices heard oral arguments in Jack Phillips’ right-of-conscience case on December 5. The day after oral arguments, the justices met in their closed session, voted on the case, and assigned an author to write a majority decision. We don’t know how the justices voted or who is writing the majority decision. The justices will announce their decision sometime before the end of the term in late June. This will be one of the most-watched cases of the term.

2. Will the Supreme Court grant review in the Rowan County legislative prayer case?

The county board of Rowan County, North Carolina, varied the practice of prayer by rotating through the members of the board. The American Civil Liberties Union challenged this practice, and the U.S. Court of Appeals for the Fourth Circuit initially upheld the practice, but on further review the full court agreed with the ACLU, 10-5, that the practice violated the Establishment Clause.

But in a second case, last September the U.S. Court of Appeals for the Sixth Circuit, 9-6, upheld the practice of county board members praying to open a meeting.  The losing parties have asked the Supreme Court to hear this case, which is made more likely because of the split with the Fourth Circuit.  CPCF filed an amicus brief supporting the board in the Sixth Circuit.

CA: Cafe Faces Eviction Over Inspirational Music And Decor

“Last October, the cafe’s religious music and inspirational decor triggered microaggressions among local atheists. A complaint was filed with the San Bernardino County Department of Real Estate Services, the cafe’s landlord. A few weeks later the Magnos were notified that their location was going to be put up for public bid status. ‘We were encouraged to include in our proposal for bid, that we would not play our religious music or have any religious decorations,’ Mr. Magno told me.”

MA: Bill Attempts To Strip Businesses From First Amendment Protections

“House Bill 767, introduced by Rep. Michael Day, is attempting to strip businesses and corporations, and thus their owners, from First Amendment protection…

“What Rep. Day’s bill would say is that if Jack Phillips were in Massachusetts and this law were passed, he wouldn’t even have his day in court, (because) it says that people of faith always lose,’ Beckwith warns. ‘And not only do they lose if they try and use their faith as a defense against discrimination claims,” Beckwith continues, ‘this law would pierce the corporate veil. So not only would they possibly lose their business, they could lose their homes in the lawsuits and the penalties and fines that come with them.'”

OH: FFRF Asks For Removal Of Prayer Plaques From Memorial

From FFRF Site: “A concerned community member in Evendale (near Cincinnati) contacted FFRF to report that in May 2017, the village spent more than $388,000 to rebuild its Veterans, Police and Fire Memorial. Part of the memorial contains seven plaques prominently displayed upon separate gray-stone pillars. Each of these plaques features an exclusively Christian prayer, with five ending “through Jesus Christ our Lord. Amen.”
